I BELIEVE DREAMS CAN COME TRUE ♡

I currently study at a college in Mexico. I'm not proud of being naive, but at least this makes me believe I can achieve more than thought possible. I believe in the possibility of living in a foreign country with more opportunities to work and complete my university studies. I am fighting for the dream of living and starting a crafts business with my girlfriend. We want that business to enrich and give back to other charity organizations. If you want to support her, you can let me know. Like me, she is dedicated to receiving commissions from other people. You can also check out her Carrd if you are interested. We will greatly appreciate your support!Artwork by @SintDrommer

DEFINITIONS

For greater clarity and precision in the terms and conditions of artistic commissions, a
section of definitions is included:
Artist: Person who possesses the necessary skills and knowledge to create works of art in
various disciplines, such as painting, sculpture, drawing, illustration, etc. In this context, the
artist refers to the professional who provides their services for the realization of a specific
artistic commission. In this case, Liaro (as the artist who will work on the commission for the
present client).
Client: Person or entity requesting the services of the artist for the creation of a personalized
work of art. The client is the one who defines the requirements, specifications, and details of the
artistic commission they desire.
Commission: Artistic assignment or project that the client requests from the artist. The
commission involves the creation of an original and unique work of art, according to the
preferences and requirements of the client.
Initial Payment: Amount of money that the client pays to the artist as an advance or deposit to
initiate the commission. This initial payment usually represents a percentage of the total cost of
the commission.
Total Cost: Total amount that the client must pay to the artist for the completion of the
commission. The total cost includes the initial payment, the artist's work, materials used, and
any other expenses related to the creation of the artwork.
Modification: Change or alteration that the client requests to be made to the artwork during the
creation process. Modifications can be minor or significant, depending on the complexity of the
change.
Modification limit: Amount of times the client can request the artist to modify the commission.
Limits will be clarified below:
Sketch part:
- Up to 3 big modifications (Redrawing all the sketch).
- Up to 3 small modifications (Redrawing a part of a body or an object).
Lineart part:
- Up to 3 modifications, which may include redrawing a part of a body, an object, or regular corrections.
Coloring part:
- Up to 2 big modifications (includes recoloring a character with other colors,
objects or background colors).
- Up to 3 small modifications (includes changing slightly to a different color
to an object or a part of a body of a character.)
Shading part:
- Additional charges may apply if the format of the shading is drastically affected.
Please ask for more information.
- Up to 2 small modifications. (Shades, lights or outlines).
Final Delivery: Moment when the artist completes the artwork and delivers it to the client.
Final delivery is made in the format agreed upon beforehand, whether physical or digital.
Copyright: Set of exclusive rights that the artist holds over their created work. These rights
include the right of reproduction, distribution, public communication, and transformation of the
work.
Personal Use: Use of the created artwork for non-commercial purposes, i.e., for the client's
personal enjoyment or appreciation.
Commercial Use: Use of the created artwork for profit or economic benefit. Prior written
authorization from the artist is required to make commercial use of the artwork.
Refund: Partial or total return of the payment made by the client to the artist. Refunds may be
applicable under certain circumstances, such as commission cancellation or client dissatisfaction
with the final artwork.
Deadline: Established period of time to carry out an action or fulfill an obligation. In the
context of artistic commissions, the deadline may refer to the time the artist has to complete the
work or the time the client has to request a refund.
Clarification: Additional explanation or specification about a specific point of the terms and
conditions. Clarifications are used to avoid confusion or ambiguity in the interpretation of the
rules.
Appeal: Process by which the client can request a review of a decision made by the artist, such
as the denial of a refund. The appeal is usually reviewed by an impartial third party who makes
a final decision.
Binding Arbitration: A process where any dispute or claim arising from these terms will be resolved
by a neutral third party (an arbitrator) instead of a court of law. Both the Artist and the Client agree
to accept the arbitrator's decision as final and legally enforceable, giving up their right to go to
court or participate in a class-action lawsuit.
These definitions aim to provide clarity and understanding to clients and artists regarding
the terms and conditions of artistic commissions.

Commission Delivery:• The minimum delivery time depends on the complexity of the commission and the artist's workload.• The artist reserves the right to choose the final delivery date, considering the nature of the commission and their current workload. The client will be notified in advance. Once the delivery date is agreed upon, the commission will be delivered within 5 days before or after the established date.• Under no circumstances will a commission be delivered without receiving full payment first.3. Previews:• A minimum advance of 50% of the total commission cost is required to obtain watermarked previews.4. If payment is not received after this period, the artist reserves the right to discontinue the commission without a refund and to include the client on a blacklist to warn other artists.5. Refunds:• A total refund of the commission can be requested before it commences. Once the commission has started, the refund percentage will depend on the case and the progress made. During the sketch stage, the client may receive a refund of up to 50% of the initial payment.• In case of requesting a refund for health reasons, the situation will be evaluated, and an exception to the 50% limit may be applied. For this, the client must provide medical documentation proving their condition.• If the commission has progressed beyond the sketch stage, a refund cannot be requested, regardless of the reason. The client must request a refund during the sketch stage.• If the artist denies a refund request, the client may appeal the decision. In such a case, both parties agree to seek a resolution through a mediation process with a neutral third party mutually agreed upon. The costs of mediation will be shared equally between the artist and the client, unless otherwise agreed.6. Copyright:• The artist reserves the right to publish the commission on any platform unless the client expressly requests it to remain private.• The client has the right to use the commission for personal and non-commercial purposes, being able to share it on different platforms as long as the appropriate credits are given to the artist.• Editable Project Files: Editable project files (e.g., PSD for drawings) will never be delivered to the Client as part of the standard commission. Final delivery is limited to the agreed-upon flat image formats (e.g., JPG, PNG, PDF).• Distribution of the final product (such as commercial purposes, AI generation feed, NFT publishing) is not allowed.7. Additional Rights and Rules:• The artist reserves the right to modify these terms and conditions at any time. The client will be notified of any changes via email if provided or the artist’s contact methods.• By making the initial payment for the commission, the client agrees to these terms and conditions.• Any disputes related to these terms and conditions will be resolved through binding arbitration.8. Additional Considerations:• It is important for the client to provide the artist with a clear and detailed description of the desired commission to avoid misunderstandings and ensure a satisfactory outcome.• The artist will communicate with the client during the commission creation process to obtain their approval at different stages.• The client can request revisions to the commission, as long as they are within the included modification limit in the initial cost.• The artist is committed to delivering a commission that meets the client's requirements, unless the client's requirements are considered ambiguous and the modification limit has been exceeded.• Once the commission has been marked as 'Final Delivery' and full payment has been received, any request for further modifications or revisions to the final file will be considered a new commission. Such requests will be subject to a new quote and a new agreement, based on the complexity of the work required and the artist's availability.• After the 'Final Delivery' of the commission, the client is solely responsible for downloading and securely storing their copy of the final file. The artist is not obligated to retain or delete copies of the commissioned file on their devices or cloud storage indefinitely after delivery and reserves the right to either delete or keep completed project files in their local storage.
